frsh AG (hereinafter also referred to as “we”, “us”, “company”) collects and processes personal data concerning you or other persons (e.g. work colleagues, family members; “third parties”). The term “data” is equated with “personal data” or “personal information”. The terms “editing” and “processing” are used synonymously.

The data that we have received in the course of establishing contact will be deleted as soon as it is no longer needed to achieve the purpose for which it was collected, your request has been fully processed and no further communication with you is necessary or desired by you. b) Contractual relationships with customers, suppliers and other business partners
In order to fulfil our contractual obligations, we process inventory data (e.g. names and addresses as well as contact data), contract data (e.g. services used, names of contact persons, payment information) of customers, suppliers and other business partners with a view to best fulfilling our contractual obligations and services as well as for invoicing and communication purposes.
E) Disclosure to third parties
We treat your personal data confidentially and only disclose it to those third parties that are listed in this Privacy Policy. This disclosure is made in connection with our contracts, the website, our services and products, our legal obligations or to protect our legitimate interests and for the purposes listed under D) above.

To this end, we have concluded contracts for order data processing with them, where necessary.

xi. offices, courts, and other authorities, if we are legally obliged or entitled to do so or if it appears necessary to protect our interests;
F) Data transfer and transmission abroad
We are also entitled to transfer your personal data to companies abroad, provided that this is done for the purpose of data processing in accordance with point D) above. We disclose your personal data in the following countries: Switzerland and the EU. If the country in question is outside Switzerland, the EU, or the EEA and no adequate level of data protection is ensured by law, we contractually oblige the recipient to comply with the applicable data protection. For this purpose, we use the standard contractual clauses of the European Commission.
G) Data security
We use appropriate technical and organisational security measures to protect your personal data stored by us against unintentional, unlawful or unauthorised manipulation, deletion, alteration, disclosure or use, partial or complete loss and against unauthorised access by third parties. Our security measures are continuously adapted and improved in line with technological developments. We do not accept any liability for the loss of data or for third parties gaining knowledge of or using data.
We also take internal data protection very seriously. Our employees and the service providers we commission are bound by us to maintain confidentiality and to comply with data protection regulations.
As a registered user, you can only access your user account by entering your personal password. You should always keep your access data confidential and log out of the user account when you have finished communicating with us, especially if the device you are using is not used exclusively by you.
H) Duration of data storage
We only store your personal data for as long as is legally necessary or in accordance with the purpose of the processing. When analysing data, we store your data until the analysis is complete. We store contract data for longer, namely for at least as long as the contractual relationship exists and for no longer than the period of limitation for possible claims by us or as long as statutory or contractual retention obligations apply. Retention obligations that require us to store data arise from accounting and tax regulations. According to these regulations, business communications, contracts, and accounting records must be kept for up to 10 years. If we no longer need this data to provide you with our services, the data will be blocked. This means that the data may then only be used for accounting and tax purposes.

We reserve the right to update and amend this Privacy Policy at any time without prior notice. The current version published on our website applies. We therefore recommend that you visit our website regularly to find out about any updates that may have been made.
